Digital messaging platforms of Aldeamo and its affiliates
The following are the terms of use of the digital messaging platforms of Aldeamo and its affiliates. Using or accessing any of the digital messaging platforms of Aldeamo and its affiliates constitutes acceptance of these terms.
The use of the digital messaging platforms of Aldeamo and its affiliates is understood to be the user's responsibility and at their own risk only. "You", "the client" or "the user" means the person or company that contracts the services of Aldeamo or its affiliates, or that uses the digital messaging platforms of Aldeamo and its affiliates.
Changes to the terms
The terms may be modified at any time without notice and will take effect the moment they are published on Aldeamo's website. It is the user's obligation to review the terms regularly to stay aware of modifications. By continuing to use the system after modifications have been made, the user accepts the changes to the terms. If the user does not accept the modifications, they must refrain from continuing to use the system.
Changes to pricing
Ranges and prices may be modified at any time and will take effect the moment they are published on the aldeamo.com website. Aldeamo undertakes to make its best effort to communicate these changes to its clients as soon as possible.
The system in general
The digital messaging platforms of Aldeamo and its affiliates are offered "as is", with no guarantee that the service will always be available or error-free.
Information processing is understood to be an obligation of means and not of result; therefore, no liability is assumed for issues related to the non-receipt of messages by recipients if this is due to failures of the mobile telephone operators. In general, every possible resource will be used to keep the service running, and any changes, maintenance or failures will be notified as far in advance as possible.
Restrictions
- The user refrains from sending information that uses offensive language or that goes against morality and good customs.
- The user refrains from any practice related to child pornography, spamming, and any other practice included in the Data Protection Policy.
- The user will refrain from activities such as attempting to access another account, network or server, or any action that harms the normal functioning of the infrastructure.
- The user must always identify themselves at the beginning or end of the message sent so the recipient knows who sent the message.
- The digital messaging platforms of Aldeamo and its affiliates operate Monday to Sunday from 8:00 a.m. to 9:00 p.m. Outside these hours the message is processed but will not be sent until the following day at 8:00 a.m.
- You must never send messages during non-business hours or hours not permitted by the national legislation of the country where the message recipient resides.
- The user must comply with all applicable legislation on digital messaging and telecommunications in the countries where the recipients of the messages they send reside.
In the event of a violation of this policy, your account on the digital messaging platforms of Aldeamo and its affiliates will be cancelled immediately.
Account termination
If the user has not logged into the application for a period exceeding 120 days, Aldeamo may delete the account after prior notice by email. The user will have 30 days to log in once the notice has been sent; otherwise, the account will be deleted along with all its information. Aldeamo may terminate an account in the event of suspected breach of the terms stipulated herein.
Refund policy
Aldeamo has a no-refund policy, except in the case of death or permanent incapacity of the registered user.
Limitation of liability
To the maximum extent permitted by law, Aldeamo WILL NOT BE LIABLE to the user or any other person for any damage or loss, whether direct or indirect, caused by the use of the system. Should Aldeamo be found liable for any damage or loss, this will be limited to the amount the user has paid for the service.
System requirements
To use the Aldeamo messaging system, a computer with Windows XP or higher as its operating system and Internet Explorer 6.0 or higher is required. Additionally, a stable Internet connection is required. The system may function in a limited way on other browsers, with no guarantee.
Beta features
In order to test new functionality, Aldeamo may offer experimental features called "beta" or "in beta stage", which the user understands may fail given their experimental status. These features will be marked as "Beta" so the user can decide whether or not to use them.
Client responsibilities
- Provide accurate, honest and complete information to contract and use Aldeamo's services. This includes information provided by third parties contracted by the client.
- Cooperate with Aldeamo by providing information about its services and systems to verify identity and confirm compliance with the quality and legality requirements of the content it delivers, thereby helping to prevent unwanted-messaging (spam) practices.
- Make appropriate use of the messaging platforms of Aldeamo and its affiliates, avoiding security vulnerabilities and overloading the platform.
- Design their messaging-based services and products understanding that messaging services such as SMS, email and voice are not completely reliable and that message delivery to recipients may fail for normal technological reasons (lack of coverage from a mobile operator, intermittencies in communication networks, defective handsets, transaction overload, etc.). Therefore, the client should not use these platforms for critical-response or emergency services.
- The client is responsible for the content and the times at which it sends messages to its users; should it breach any rule defined by the regulator governing the sending operation, it will fully assume the corrections, amendments, fines, effects and penalties that may arise.
Prohibited actions
Neither you nor third parties you contract are authorized to:
- Attempt to interfere with the proper functioning of Aldeamo's messaging platforms.
- Attempt to improperly or fraudulently collect personal or confidential information such as national identification numbers, payments or financial data such as credit card numbers, bank accounts, system access credentials or answers to security questions.
Authorization to use your services
- You authorize Aldeamo and its affiliates to use the content of your messages for statistical purposes to improve Aldeamo's service and platforms, as well as to present you with statistical reports of your usage.
- Should the client need to send messages from its systems to any of Aldeamo's messaging platforms, the client authorizes Aldeamo to interconnect with the client's systems solely to allow the sending of the client's messages to Aldeamo's digital messaging platforms and to calculate the corresponding usage metrics and statistics of Aldeamo's services.
Data Protection Policy
By registering and accepting our Terms of Use, you are also accepting our Personal Data Processing Policy, published on our website.
The user must have authorization from the data subjects to process their data, as well as explicit authorization to contact the subjects and send them messages (SMS or emails, among others). The user must be able to prove such authorization and must implement the necessary means to preserve that proof. Likewise, the user, as the party responsible for processing personal data, undertakes to comply with the regulatory provisions on personal data protection, in particular Law 1581 of 2012 and the rules that regulate, replace or amend it.
To send any message through https://smsi.aldeamo.com, you must have obtained direct authorization from the recipient. This can be done through the following mechanisms:
- A subscription form on your website.
- An optional checkbox on a physical form.
- A business card you have received where you requested permission to send information.
- Your direct clients, suppliers and employees.
Aldeamo will only provide a platform for sending communications and will not be responsible for data processing.
